Abstract

This brief study deals with the need to balance the value of music, an artistic expression to be manifested – and spread – freely, with the right of listeners, especially if unintentional, to choose whether, what, how much, and when to integrate it into their personal sphere. The legal problem cannot be fully resolved by resorting to the regulation that addresses noise pollution, which concerns noise, but requires a broader reflection on the nature of musical cultural activity, in search for a suitable and balanced placement within the legal system.
